SAN ANTONIO -- A man convicted of killing a police officer seven years ago was in court Monday in search of a new trial.Manuel Garza, convicted in the shooting death of San Antonio police officer John "Rocky" Riojas, is seeking a new trial because of improper representation, his new attorney said.In addition to the motion for a new trial, his new attorney asked the judge to prevent uniformed officers from appearing in the courtroom during the proceedings. The judge denied the request.
The hearing continued with testimony by a witness who said she believes Garza is not a killer."When he's frightened, especially if he thinks he's going back to jail, he had a pattern of running," said Kathryn Allen, a family sociologist. "So in terms of confronting, to kill, it would be an anomaly."The hearing ended late Monday afternoon and is expected to continue next week.Garza is facing the death penalty, but because of the state's current moratorium on executions, his date has not been set.
